Our Medicaid Asset Protection Practice

If you are over 65 or are disabled, you can qualify for reimbursement of health expenses under Medicaid. We can help you protect your assets from seizure by the government so that you can pass more of your estate to your family members and loved ones. With proper legal representation and planning, you can shelter a certain amount of assets, in addition to your home, for distribution to your spouse.

Medicaid asset protection generally takes one of two forms:

  • Crisis planning. This applies when you or a loved one has already been admitted to a nursing home or is about to be admitted. We have a quick response system in place for crisis Medicaid planning, and can help you get answers quickly. We can often tell you within hours, not days, whether we can save you money. If you have a medical emergency that qualifies you for Medicaid, we can help you take immediate steps to protect your assets, while remaining eligible for benefits.
  • Five-year planning. This entails planning ahead to make sure you will be eligible for Medicaid while still protecting your assets for your spouse or children. The bottom line is that you don't have to go broke for in home or nursing home care. The law allows people to keep their homes and much of their money- if they know how, but it is critical to have the assistance of those like us who know how to do it.

Medicaid Assistance

We can also assist you with Medicare issues, which are available if you are impoverished, regardless of your age. We will help you prepare and file an application for Supplemental Security Income (SSI) payments, as well as food stamps, when appropriate. In certain situations, we can help you get assistance with daily needs, including shopping, cleaning and laundry.
